Who needs the DISC-001 form?
The DISC-001 is the California court form, the full name of which is Form Interrogatories - General. This form was created to be used in civil court proceedings on an optional basis by the defendant or the plaintiff. According to the definitions stated by the form there is both an asking party and an answering party.
What is the purpose of the Form Interrogatories-General?
The DISC-001 form is a list of checkboxes for questions that should be answered. The questions that are allowed to be asked are who, what, when, where, why-questions, which turns them into a helpful method to obtain new information in a case. However, it should be mentioned that for some situations, the given interrogatories may be useless, which is why usage of the DISC-001 form is not the only means by which information is gathered.
The particular Form DISC-001 is to be used in unlimited civil cases (those exceeding $25,000). For unlimited civil cases, an unlimited number of form interrogatories can be asked correspondingly, unlike in limited cases. For the latter, only 35 interrogatories are allowed.
When is the Form Interrogatories-General Due?
The form DISC-001 can be served when the need arises -- there is no strict limitation. However, the response of the answering party must be delivered no later than 30 calendar days after the Interrogatories’ receipt, unless the 30th day falls on the weekend.
How to fill out the DISC-001 Form?
As has been mentioned, the form is basically a list of items with checkboxes that should be checked if the asking party finds it appropriate. However, the top part of the form must also include some basic information about the case:
- The details about the attorney;
- The address of the Superior Court;
- Short title of the case and its number;
- The data about the asking and answering parties.
